It’s the largest single UDRP filing by Facebook to date, and only its second to include brand+keyword domains.”

Frank Shilling, is no stranger to UDRP proceedings. If one owns more domain names than there are stars in the sky, more than a few of them are likely to be fodder for litigation. It is probably fair to say that it’s unremarkable for anyone owning more than a few thousand domain names to do the UDRP dance a time or two.
What is remarkable is when a domainer gets into the ring with a big company and wins. In Frank Shilling vs. The New York Times Company, The Doctrine of Laches saved the day. In the case for the domain in question, DealBook.com, the panel describes the invocation of Laches as “an equitable doctrine that may provide a defense when an adverse party has unreasonably delayed in asserting his rights to the detriment of the accused.”
This certainly opens interesting possibilities for future UDRP proceedings.

From ICANN Announcements
ACDR Proposal to be Recognized as an Official Dispute Resolution Provider Under the UDRP
ICANN has received a proposal from the Arab Center for Domain Name Dispute Resolution (ACDR) to be recognized as one of the official dispute resolution providers under the UDRP. The proposal was submitted pursuant to the process specified HERE.
The ACDR is jointly established by the Arab Intellectual Property Mediation and Arbitration Society (AIPMAS) and the Arab Society for Intellectual Property (ASIP), with headquarters in Amman, Jordan and additional offices in other Arab Countries. Both the AIPMAS (established in 1987) and ASIP promote the activities of the Arab Center of Mediation and Arbitration, established in 2003, active in resolving conflicts related to intellectual property through international arbitrators. If approved, the ACDR would be the first Approved UDRP Dispute Resolution Service Provider headquartered in an Arab state.

The Czech Arbitration Court CAC recently announced a reduced filing fee for complaints filed under the popular Uniform Domain Name Dispute Resolution Policy UDRP that involve “expedited decisions.” (Although not as well known as the World Intellectual Property Organization WIPO or the National Arbitration Forum NAF, CAC has offered UDRP services since January 2009.)
NameSmash contributor, Doug Isenberg, an attorney with the GigaLaw Firm has assembled a brief Q&A to answer some of the most important questions about this new fee structure. Doug has counseled clients on domain name disputes since 1996 and serves as a domain name panelist at the Czech Arbitration Court and the World Intellectual Property Organization.
Q: What is CAC’s reduced fee for UDRP complaints?
A: For a UDRP complaint involving one to five domain names and a single panelist, CAC’s “initial” filing fee – as of March 15, 2010 – is 500 Euros (about $685). By comparison, CAC’s filing fee for an identical case previously had been 1,300 Euros (about $1,800). Thus, the new fee is about 62% lower than the old fee.
Q: How does CAC’s new filing fee compare to the other UDRP service providers?
A: At WIPO, the filing fee for a similar UDRP complaint is $1,500. At NAF, the filing fee for a UDRP complaint involving one or two domain names and a single panelist is $1,300.

As reported by Domain Name Wire “Hostess, the bakery that sells treats such as Twinkies and Ding Dongs, has lost a domain dispute over Hostess.com.
The domain name was purchased at the TRAFFIC auction in New York in 2007 for $44,000 and hasn’t been used since then. That proved to be a problem for Hostess, since the panel was not persuaded the domain was registered in bad faith given no evidence.”
